OFFICE MEMORANDUM

Subject: Clarification on increase in certain allowances by 25% after enhancement of Dearness Allowances w.e.f. 01.01.2024.

The undersigned is directed to refer to para 2(e) of this Department’s O.M. No.A-27012/02/2017-Estt (AL) dated 17.07.2018. This provides that the limits of Children – Education Allowance and Hostel Subsidy would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%. References are being received from various quarters with regard to the amount of Children Education Allowance (CEA) and Hostel Subsidy admissible consequent upon enhancement of Dearness Allowance payable to Central Government employees @ 50% w.e.f. 1st January, 2024 announced vide Ministry of Finance, Department of Expenditure O.M. No. 1/1/2024-E-II (B) dated 12″ March, 2024.

2. Subject to other conditions mentioned in this Department’s O.M. No.A-27012/02/2017-Estt.(AL) dated 17-07-2018, the following shall be the revised limits for CEA and Hostel Subsidy:

a) The amount for reimbursement of Children Education Allowance shall be ₹ 2812.5/- per month (fixed)and Hostel Subsidy shall be ₹8437.5/- per month (fixed) irrespective of actual expenses incurred by the Government employee;

b) The reimbursement of Children Education Allowance for Divyang children of Govt. employees shall be payable at double the normal rates i.e.₹5625/-per month(fixed), irrespective of actual expenses incurred by the Government employee;

3. The rates of Special Allowance for Child Care to women with disabilities stands revised to ₹ 3750/-per month subject to other conditions mentioned in this Department’s O.M. No. A-27012/03/2017-Estt.(AL) dated 16.08.2017.

4, These revisions are applicable with effect from 1st January 2024.

Subject:- Leave

Department of Personnel & Training has issued various OMs from time to time in exception to the CCS (Leave) Rules 1972 applicable to Central Government Employees. The essence of these OMs has been summarized in the following paras for guidance and better understanding.

1. Grant of maximum 42 days Special Casual Leave to Organ Donors

Keeping in view the noble activity to help another human being and to promote organ donation among the Central Government employees, the Government has decided to grant a maximum of 42 days Special Casual Leave to a Central Government servant for donating their organ(s) to another human being, as a special welfare measure in public interest, notwithstanding the provision under Appendix-III of the CCS (Leave) Rules 1972 regarding grant of Special Casual Leave not exceeding 30 days in any one calendar year under certain terms and conditions.

2. Grant of 60 days Special Maternity Leave in case of death of a child soon after birth / stillbirth

Keeping in view the potential emotional trauma caused due to stillbirth or death of a child soon after birth, which has a far-reaching impact on the mother’s life, the Government has decided to grant a Special Maternity Leave of 60 days to a female Central Government servant in case of death of a child soon after birth / stillbirth under certain terms and conditions.

3. Leave encashment to officers appointed on contract in various posts under Government

Consequent upon the decision taken by Government, officers who are appointed on contract in various posts under the Central Government are allowed to encash 10 days earned leave at their credit on the date of termination of contract, subject to the condition that for each completed year of service put in by him / her in the post in-such contract appointments. While calculating the encashment of leave in such a contract appointment, the number of days of leave for which encashment had been allowed in previous appointment, if any, under the Government shall not be taken into account.

4. Grant of Special Casual Leave for the purpose of blood donation

Consequent upon the decision taken by Government, grant of Special Casual leave for blood donation has been extended for blood donation for apheresis (blood component such as red cells, plasma, platelets etc) for four times in a year under certain conditions.

Subject: Modification/Revision in instructions regarding authorities competent to issue Caste/Tribe/Community certificates in respect of SC/ST/OBC and Income and Asset Certificates in respect of EWS -reg.

Sir/Madam,

I am directed to state that this Department has issued instructions to the State Government/U.T Administration from time to time prescribing the authorities of the State Governments /U.T. Administrations, who are competent to issue Caste/Tribe/Community certificates in respect of SC/ST/OBC and Income and Asset Certificates in respect of EWS. However, it has come to the notice of this Department that in some States, such Certificates have not been issued by the authorities prescribed by this Department, leading to avoidable hardship for the candidates.

2. In this regard, it is stated that the responsibility for issue and verification of caste/community certificate lies with the concerned State Government/UT Administration. The Hon’ble Supreme Court, vide its judgement in the matter of ‘Kumari Madhuri Patil vs Addl. Commissioner’, has already laid down detailed guidelines to be followed by the State Government to streamline the procedure for the issuance of social status certificates, their scrutiny and their approval. The State Governments/UT Administrations are required to streamline the procedure for issuance and verification of Caste/ Tribe/Community certificates in respect of SC/ST/OBC and Income and Asset Certificates in respect of EWS keeping in view the directions of the Hon’ble Supreme Court, vide its order in ‘Kumari Madhuri Patil vs Addl. Commissioner’.

3. In view of the aforesaid judgement of the Hon’ble Supreme Court, it has been decided to delegate the powers to the State Governments/UT Administrations to decide the authorities competent to issue the Caste/ Tribe /Community certificates in respect of SC/ST/OBC and Income and Asset Certificates in respect of EWS candidates. The State Governments/UT Administrations shall upload on their website the details of the authorities competent to issue such Caste/Tribe/Community/Income & Asset certificate.

The earlier instructions issued vide OM No. 36012/6/88-Estt (SCT) dated 24.4.1990 and letter No. 36012/22/93-Estt (SCT) dated 15.11.1993 (copies enclosed) with regard to the authorities prescribed for issuance of Caste/Tribe/Community certificates in respect of SC/ST/OBC and OM No. No.36039/1/2019-Estt (Res) dated 31.01.2019 (copies enclosed), with regard to the authorities prescribed for issuance of Income and Asset Certificates in respect of EWS are modified to that extent.
