As part of overall superintendence over vigilance administration of organizations covered under its advisory jurisdiction; the Central Vigilance Commission has been emphasizing on timely completion of all stages of vigilance cases and disciplinary proceedings. The Commission has also issued guidelines about specific timelines to be observed for conducting departmental proceedings, so that cases can be brought to logical conclusion in a time bound manner.

2. A time limit of 6 months has been prescribed for the Inquiry Officer (IO) to complete the inquiry and submit report to the Competent Authority. However, it has been observed that in a substantial number of cases, completion of inquiry and submission of inquiry report is taking more than 6 months’ period. One of the reasons contributing to such delay is due to frequent change of IO as a result of transfer, promotion, retirement etc. of the earlier IO.

3. The Commission has desired that in order to ensure timely completion of departmental inquiry, the same IO should continue to conduct inquiry, even after his transfer or promotion, till the inquiry report is submitted by him. In case of transfer of IO to a new station, either his transfer orders may be given effect after submission of Inquiry Report or digital mode / video conferencing may be used for conducting / continuing with the departmental inquiry. It may be noted that DoPT, vide their OM No. 142/40/2015-AVD.I dated 15.09.2017 & OM No. 11012/03/2020-Estt.A-III dated 05.08.2020 have issued guidelines for maximizing the use of Video Conference facility for conducting departmental inquiry. However, in case of unavoidable circumstances, the IO may be allowed to visit earlier station for conducting ongoing inquiry / inquiries.

4. Further, it may also be ensured that a person who 1s due to retire shortly (may be within a period of one year), is not appointed as IO. In case the departmental inquiry gets delayed due to any reason and the IO retires before submission of inquiry report, he may be considered for continuing as IO even after his retirement, subject to his willingness and other conditions applicable to appointment of retired officials as IOs. It may be kept in view that DoPT, vide their OM No. 142/40/2015-AVD.I dated 15.09.2017 and OM No. 1668597747466 dated 16.11.2022 have issued guidelines for appointment of a retired person as IO and for payment of honorarium to such IOs.

5. The above guidelines may be noted for compliance with immediate effect.

Subject: Reversion to feeder cadre and declination of promotion to Inspector Posts Cadre— reg.

I am directed to refer to above mentioned subject and to say that Directorate is in receipt of various representations related to declination of promotion through LDCE to the cadre of Inspector Posts and requests for reversion to feeder cadre after joining promoted post of Inspector Posts.

2. As per Schedule of appointing and disciplinary authority, Director Postal Services is the appointing authority of Inspector Posts cadre and hence the acceptance of declination for promotion maybe done by DPS of parent Circle under intimation to Directorate.

3. Further, in case of reversion to feeder cadre, DPS of the Postal Circle where official is working as Inspector Posts may consider such requests in consultation with parent Circle of the official in feeder cadre. Cases where an official is allotted to his / her parent Circle, DPS concerned may take a decision. Cases decided by Circle may invariably be informed to Directorate.

4. This issues with approval of the competent authority.

Subject: Revision of Date of joining and preponement of financial upgradation and MACP-I in respect of PAS (CO/RO) O/O CPMG Hyderabad duly taking into account the induction training period at PTC, Madhurai from 29.03.2010 to 15.05.2010 - regarding.

 

Madam/Sir,

I am directed to refer to Directorate's communication of even number dated 24.04.2023 (copy enclosed) on the subject mentioned above.

 

2. The matter has been revisited keeping in view of various instructions issued by Department of Personnel & Training (DoP&T) and Pay Commission Cell (PCC) of the Directorate for the purpose of grant of MACP.

 

3.Therefore, Competent Authority has decided to withdraw the instruction issued vide communication of even number dated 24.04.2023. Circle is requested to take necessary action accordingly. Orders, if any, issued by Circle, based on aforesaid letter dated 24.04.2023, shall be withdrawn by the Circle.

"CERTIFICATE OF POSTING " - DISCONTINUED

 Sub: Discontinuation of 'Certificate of Posting'.



                       .G. Posts No.2-4/2008-PO dated 23.02.2011.

Under the provisions of Rule 195 of the Indian Post Office Rules , 1933 'Certificate of Posting' is granted to the public to afford an assurance that letters and other articles for which no receipts are granted by the Post Office and entrusted to servants or messengers for posting have actually been posted.

It has since been decided that' Certificate of Posting' may be discontinued immediately.

A copy of Gazette Notification No. 58(E) dated 31.1.2011 deleting rule 195 of the Indian Post Office Rules, 1933 regarding 'Certificate of Posting' is enclosed for information and necessary action.

This may kindly be brought to the notice of all concerned for strict compliance.

The receipt of this communication may also be acknowledged.

GSR.58(E)- In exercise of the powers conferred by clause (d) of sub-section (2) of Section 21 read with section 74 of the Indian Post Office Act, 1898 (6 of 1898), the Central Government hereby makes the following rules further to amend the Indian Post Office Rules, 1933, namely:-

1. (1) These rules may be called the Indian Post Office (Third Amendment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Post Office Rules, 1933, in part VIII relating to "General Rules", the heading "III-Certificate of Posting "and rule 195 shall be omitted.

In connection with the above subject, the following clarification is issued for information. Incentive schemes for BPMS was introduced for securing greater mobilization of savings A/cs in rural areas.

During stop gap arrangement of BPMs, the person engaged for the work in BO is to perform all work of a BPM, for which TRCA is paid. Since, incentive scheme is applicable for BPMS, there is no bar in paying TD commission to persons engaged as BPM during stop gap arrangements

Subject: Merger of PA (SBCO) and PA (FPO) with PA (PO) regarding.

Madam /Sir,

As you are aware, the proposal for merger of PA (CO/RO)(SBCO)A(FPO) with PA (PO) was under consideration of this Directorate for quite some time.

2. In this regard, it has been decided, with the approval of the Competent Authority, to merge the PA (SBCO) and PA (FPO) with PA (PO) with effect from 01.01.2023. The detailed modalities for merger of PA (SBCO) and PA (FPO) with PA (PO), formulated in consultation with Personnel Division (SPN Branch), are attached as Annexure-A and Annexure-B respectively.

3. However, the PA (CO/RO) shall remain a separate cadre.

4. Further, modalities regarding merger of LSG and HSG posts of SBCO and FPO with Postal Operative Side would be conveyed in due course.

5. If the Circles face any issue related to merger of posts, the matter may be referred to ADG (PE-I), and issues pertaining to merger of personnel, seniority, Rule 38 of Postal Manual Vol. IV and other related issues may be referred to Director/ADG (SPN) directly.

Annexure -A to Letter No. Q-25/11/2022-PE-I-DOP dated 16.11.2022

1. Modalities for merger of Postal Assistant (SBCO) cadre:

a) No further appointment will be made in PA (SByO) cadre w.e.f. 01.01.2023.

b) Existing incumbents of PA (SBCO) cadre shall continue to be in PA(SBCO) cadre till they are promoted to next higher grade in SBCO cadre or cease to be in service.

c) Existing incumbents of PA (SBCO) cadre may make a request in writing to switch over to PA (PO) cadre and such requests shall be received till 31.12.2022. Those officials of PA (SBCO) cadre who shall submit request to switch over to PA (PO) cadre before the prescribed date shall be taken on the strength of the Postal Division / Unit where the official is presently working. However, such an official may make a request for posting in any other Division / Unit of the Circle and in such cases the official shall invariably be taken on the strength of that Division / Unit, if vacancy is available.

d) Such officials who switch over to PA (PO) cadre shall be placed en-bloc below all those officials of PA (PO)’s gradation list of the Circle as on 31.12.2022. Inter se seniority of those officials of PA (SBCO) cadre, who chose to switch over to PA (PO) cadre, shall be the same as was in PA (SBCO) cadre [Explanation : If A, B and C were holding the posts of PA(SBCO) and placed at S. No. 5, 15 and 27 of PA(SBCO) seniority list, then after their switch over to PA(PO) cadre, they will be placed in the same order i.e. A will be senior to B and B will be senior to C].

e) Officials of PA (SBCO) cadre who choose to switch over to PA (PO) cadre in Postal Operative Side shall not be allowed to revert back to SBCO Cadre and their further promotion shall be in the hierarchy in Postal Operative Side. Even after promotion to next higher grades of LSG, HSG etc., they will continue in the Postal Operative Side.

fj Existing officials, who choose to continue in SBCO, will only be considered for promotion in the existing hierarchy in SBCO supervisory cadre, as per availability of posts.

g) To ensure that there is no large scale dislocation of officials, feeder Division(s) for an SBCO would be the local Postal Division where the SBCO is geographically located. All existing vacant posts of PA(SBCO) cadre as on the crucial date. i.e. 01.01.2023. and the posts held by the officials. who are allowed to switch over to PA (PO) cadre in Postal Operative Side, shall be added to the strength of the respective Postal Division / Unit where SBCOs are located and such Postal Division / Unit shall be the feeder Division / Unit for posting manpower to SBCO against the posts. At the same time equal number of posts will be reduced from the strength of SBCO. For example, if in a Circle/Unit the sanctioned strength of PA(SBCO) cadre is 100 and 30 posts are vacant and 10 officials opt for PA (PO) cadre, then these 40 posts (30 vacant posts + 10 posts for switch over) will be added to the strength of the Postal Division / Unit for making recruitment and posting of officials. However , for providing manpower, strength of PA (SBCO) cadre will continue to be 100.

h) Posts that shall be vacated in future, in PA (SBCO) cadre, due to retirement / promotion etc., shall also be added to Postal Divisions in the above manner and ultimately entire strength of PA (SBCO) cadre would be added to the strength of Postal Divisions in due course. However, sanctioned establishment (number of sanctioned posts) of SBCO Branch, as decided from time to time, will continue to remain the same for the purpose of posting of officials.

i) Record of number of posts added, in the manner as mentioned in (g) & (h) above, must be maintained separately in the establishment register of the concerned Division/Unit.

j) Posting of PA in SBCO will be done from Postal Divisions on tenure basis through Transfer and Placement Committee (TPC) of the Division. However, transfer/posting of PA (SBCO) who chooses to continue in SBCO cadre shall be decided as per extant rules/procedure/practice. Transfer/posting of officials who do not opt to . switch over to Postal Operative Side will be made first by the Circle/Regional Office and thereafter, the Divisional TPC will consider transfer/posting for the remaining vacancies in SBCO.

k) Posting of officials in SBCO should be finalized by the concerned Divisional heads. However, while making such posting the divisional head will ensure that the official so posted in SBCO, is well conversant with Savings Bank / Saving Certificates rulings, having good record of service and adequate knowledge of relevant software. If required, in house training may be imparted to the official so posted in SBCO Branch.

1) Such Postal Assistants, who are working in Savings Bank / Savings Certificate Branch of MDG / HOs, and other bigger offices (LSG and above before cadre review), and also working in ‘A’, ‘B’ and ‘C’ class Sub-Post Offices should not be posted in SBCO branch immediately on completion of such tenure. Posting of an official in SBCO branch shall be on tenure basis and no extension of post tenure shall be allowed. Further, no official shall be re-posted in SBCO branch before giving a break of post tenure (three years) outside SBCO branch.

m) Existing incumbents of PA (SBCO) cadre who are allowed to switch over to PA (PO) cadre in Postal Operative Side shall be eligible for both Inter-Circle and Intra-Circle transfer under Rule-38 of Postal Manual-IV in PA (PO) cadre in Postal Operative Side.

a) No further appointment will be made in PA (FPO) cadre w.e.f. 01.01.2023.

b) PA (FPO) cadre of Chennai, Delhi and Kolkata shall be straightway merged with PA (PO) cadre of the Postal Division where the FPO is presently located geographically.

c) Existing incumbents of PA (FPO) cadre, Mumbai shall continue to be in PA(FPO) cadre till they are promoted to next higher grade in FPO cadre or cease to be in service.

d) Existing incumbents of PA (FPO) cadre, Mumbai may make a request in writing to switch over to PA (PO) cadre and such requests shall be received till 31.12.2022. Those officials of PA (FPO) cadre who shall submit request to switch over to PA (PO) cadre before the prescribed date shall be taken on the strength of the Postal Division / Unit where the FPO is presently located geographically . However , such an official may make a request for posting in any other Division / Unit of the Circle and in such cases the official shall invariably be taken on the strength of that Division / Unit, if vacancy is available.

Your kind attention is drawn to Rule 3(2) (iii) & (iv) of CCS Conduct Rules 1964 which is given below:
"Rule 3(2)(iii) The direction of the official superior shall ordinarily be in writing. Oral direction to subordinates shall be avoided, as far as possible. Where the issue of oral direction becomes unavoidable, the official superior shall confirm it in writing immediately thereafter;

Rule 3(2)(iv) 'A Government servant who has received oral direction from his official superior shall seek confirmation of the same in writing as early as possible, whereupon it shall be the duty of the official superior to confirm the direction in writing".

2.It is requested that provision under Rule 3(2) (iii) & (iv) of CCS Conduct Rules 1964, may be strictly adhered to and necessary compliance ensured at all levels.
